Court Orders 94 Million Soums in Damages for Unauthorized Use of Uzum Brand
Tashkent, Uzbekistan (UzDaily.com) — The Intellectual Property Center under the Ministry of Justice has reported the detection and prevention of trademark rights violations involving Uzum Tezkor and Uzum Food.
According to the agency, a food establishment owned by the company F.T. unlawfully used the name Uzum Milliy Oshxona ("Uzum National Eatery"), which was visually and phonetically similar to the registered brands Uzum Tezkor and Uzum Food. These trademarks are the intellectual property of Uzum Tezkor LLC.
The trademark holder filed a formal complaint regarding the unauthorized use of the brand and initiated legal proceedings against the infringing party. In addition, the company filed a lawsuit seeking compensation for damages and violation of its exclusive rights.
The court proceedings concluded on 28 July with a ruling in favor of the plaintiff. Under the court’s decision, the company F.T. is ordered to pay 75 million soums in damages. Including court fees and state duties, the total amount to be recovered amounts to 94 million soums.
It is worth noting that in April of this year, the Competition Development Committee granted Uzum Tezkor the status of a dominant digital platform in the market. As the company clarified at the time, it meets the key criteria in terms of customer base and revenue, even though the food and grocery delivery segment represents a relatively small portion of its overall business.
